SOLE REVIVAL AND REDEMPTION LLC
TRADEMARK, BRAND & DESIGN-INSPIRED PRODUCT COMPLIANCE POLICY
Effective Date: April 2, 2026
Document Status: Official Compliance Policy
Intended Use: Internal Compliance, Legal Review, Platform Review, and Rights-Holder Communications
SECTION 1: INTRODUCTION AND COMPANY OVERVIEW
Sole Revival and Redemption LLC (“SRR” or the “Company”) is an independent seller of custom, independently sourced, tribute, fantasy-build, and design-inspired footwear, apparel, and fashion merchandise.
SRR is not affiliated with, sponsored by, endorsed by, licensed by, or otherwise authorized by any third-party footwear, apparel, sportswear, luxury, fashion, or other brand except where SRR expressly states otherwise.
Certain SRR products celebrate recognizable aesthetics, styles, silhouettes, cultural influences, color concepts, or other elements associated with popular footwear and fashion.
SRR maintains policies and practices intended to promote compliance with applicable intellectual-property, trademark, advertising, and consumer-protection law, including the Lanham Act.
Federal law prohibits commercial uses of words, names, symbols, devices, false designations of origin, or false or misleading representations that are likely to cause confusion regarding affiliation, connection, association, origin, sponsorship, or approval. [law.cornell.edu]
SECTION 2: NATURE OF SRR PRODUCTS
2.1 Custom, Tribute, Fantasy-Build and Design-Inspired Products
Certain merchandise offered by SRR is independently produced or customized merchandise inspired by recognizable styles, aesthetics, silhouettes, themes, or cultural references.
SRR distinguishes such merchandise through terms including:
- SRR Tribute
- Fantasy Build
- Custom Build
- Design-Inspired
- Style-Inspired
These classifications are intended to inform consumers about the nature of the merchandise and distinguish it from authentic retail releases originating from third-party brands.
2.2 No Representation of Third-Party Authenticity
Unless a listing expressly identifies merchandise as an authentic retail product from a particular manufacturer, SRR does not represent its Tribute, Fantasy Build, Custom Build, or Design-Inspired merchandise as:
- Authentic retail merchandise manufactured by a referenced third party
- Official releases of a referenced brand
- Licensed products of a referenced brand
- Authorized products of a referenced brand
- Sponsored or endorsed products
- Products manufactured by the referenced brand
SRR intends that customers understand before purchasing whether they are purchasing an authentic retail item or an independently produced/custom SRR offering.
SECTION 3: THIRD-PARTY BRAND REFERENCES
3.1 Descriptive References
SRR may reference third-party names or recognizable product terminology when reasonably necessary to communicate a product’s aesthetic inspiration, stylistic lineage, compatible style, cultural reference, or design concept.
Such references are intended to describe the inspiration or reference point of the SRR product rather than identify the third-party company as the source of SRR merchandise.
3.2 SRR as Source
SRR identifies Sole Revival and Redemption as the seller and source of SRR custom, Tribute, Fantasy Build, and Design-Inspired merchandise.
SRR does not intentionally market third-party trademarks as SRR’s own trademarks or intentionally represent an unauthorized third-party relationship.
SECTION 4: NOMINATIVE AND DESCRIPTIVE REFERENCES
SRR recognizes that U.S. courts have addressed circumstances in which referring to another party’s trademark may be necessary to identify or describe the party, its products, or the subject being referenced.
The Ninth Circuit's New Kids on the Block v. News America Publishing decision articulated a nominative-use framework considering whether the product or service can readily be identified without the mark, whether only so much of the mark as reasonably necessary is used, and whether anything suggests sponsorship or endorsement. [openjurist.org]
SRR does not characterize that Ninth Circuit decision as controlling authority for SRR in North Carolina.
Instead, SRR uses the principles as general compliance guidance when determining whether and how a third-party brand reference is reasonably necessary.
SRR intends to:
- Use third-party terminology only where reasonably useful to communicate the relevant reference or inspiration.
- Avoid unnecessary use of third-party branding in marketing.
- Avoid representations suggesting sponsorship, licensing, authorization, or endorsement where none exists.
- Clearly identify SRR as the source of its custom merchandise.
SECTION 5: CONSUMER CONFUSION AND PRODUCT APPEARANCE
SRR recognizes that trademark concerns are not limited to the words used in a product listing.
Trademark analysis may consider similarity in appearance and overall commercial impression. [uspto.gov], [uspto.gov]
Trade dress can also encompass the overall appearance of a product, including product design, shape or configuration, color, texture, graphics, and combinations of design elements. [tmep.uspto.gov]
Therefore, SRR does not assume that a disclaimer, standing alone, automatically resolves every potential intellectual-property issue associated with a particular product design.
Instead, SRR's compliance practices are intended to reduce the likelihood of consumer confusion and clearly distinguish SRR and its custom merchandise from third-party brands.
SECTION 6: SRR BRAND-LANGUAGE STANDARDS
Approved Terminology
SRR may use terminology such as:
Design-Inspired
Indicates the aesthetic or cultural inspiration of an independently offered product.
Custom Build
Identifies merchandise incorporating independent customization or construction.
Fantasy Build
Identifies a creative product concept that is not represented as an authentic retail release from the referenced brand.
SRR Tribute
Identifies an independently offered SRR product intended as a creative tribute or homage.
Style-Inspired
Describes stylistic influence without representing third-party manufacture, authorization, licensing, sponsorship, or endorsement.
SECTION 7: PROHIBITED SRR MARKETING PRACTICES
SRR prohibits knowingly:
- Representing an independently produced SRR product as an authentic retail release manufactured by another company.
- Claiming third-party authorization, sponsorship, licensing, partnership, or endorsement that does not exist.
- Representing SRR as an authorized dealer of a brand where no such authorization exists.
- Using misleading descriptions intended to cause customers to believe an SRR custom product originated from another company.
- Using misleading tags or metadata intended to falsely indicate commercial affiliation.
- Omitting applicable Custom, Tribute, Fantasy Build, or Design-Inspired disclosures from products for which those disclosures are required.
SRR will periodically review its product listings and marketing practices for continued compliance.
SECTION 8: OFFICIAL CUSTOMER PRODUCT DISCLOSURE
SRR CUSTOM / TRIBUTE / FANTASY BUILD / DESIGN-INSPIRED DISCLOSURE
This product is an independently offered SRR Tribute, Fantasy Build, Custom Build, or Design-Inspired item. Unless expressly stated otherwise, it is not represented as an authentic retail release manufactured, licensed, sponsored, endorsed, or authorized by any third-party brand referenced as a source of design inspiration.
Any third-party names or references appearing in this listing are intended to identify or describe the product's design inspiration, aesthetic reference, style, or cultural influence and are not intended to represent the source of the merchandise or imply affiliation, authorization, licensing, sponsorship, or endorsement.
Materials, colors, construction, detailing, placement, and finish may vary between individual custom builds. Customers should carefully review the product photographs, description, and disclosure before purchasing.
This replaces the more absolute statement in the previous policy that SRR is necessarily “in full compliance” merely because the disclosure exists.
SECTION 9: CUSTOMER EXPECTATIONS AND PRODUCT AUTHENTICITY
Customers purchasing merchandise expressly identified as an SRR Tribute, Fantasy Build, Custom Build, or Design-Inspired product are being informed before purchase that the merchandise is independently offered custom/design-inspired merchandise rather than an authentic retail release manufactured or authorized by the referenced third-party brand.
Accordingly, the fact that an item is a disclosed SRR Custom, Tribute, Fantasy Build, or Design-Inspired product is not, standing alone, a product defect or fulfillment error when that characteristic was clearly disclosed before purchase.
This does not limit a customer's rights regarding verified damage, a qualifying defect, an incorrect item, or another substantiated problem covered by SRR's applicable return/refund policy or mandatory law.
SECTION 10: DESIGN AND TRADE-DRESS REVIEW
SRR recognizes that intellectual-property analysis can concern more than logos and names.
Because product design itself can potentially constitute trade dress, SRR may evaluate products for issues concerning distinctive nonfunctional product-design features, overall commercial impression, and potential consumer confusion. The USPTO expressly recognizes product design as a form of potential trade dress. [tmep.uspto.gov]
SRR therefore does not adopt an internal rule that:
“A product can look exactly like another company's product as long as SRR puts a disclaimer on it.”
Instead, products and marketing should be considered as a whole, including their appearance, branding, descriptions, disclosures, presentation, and likely consumer understanding.
SECTION 11: PLATFORM AND RIGHTS-HOLDER COOPERATION
SRR intends to cooperate professionally with legitimate intellectual-property inquiries from ecommerce platforms, marketplaces, regulators, and rights holders.
When an intellectual-property concern concerning a particular listing or design is brought to SRR's attention, SRR may review:
- The particular product
- Product photographs
- Listing language
- Third-party marks appearing on the merchandise
- Product-design elements
- Applicable disclosures
- Advertising and metadata
- Relevant asserted intellectual-property rights
SRR may modify or remove listings where appropriate following review.
SECTION 12: CONTINUING COMPLIANCE
SRR intends to:
- Maintain clear disclosure of custom and design-inspired merchandise.
- Distinguish SRR products from authentic third-party retail releases.
- Avoid unsupported claims of sponsorship, authorization, licensing, or endorsement.
- Maintain its own identity as the source of SRR products.
- Periodically review product descriptions and marketing practices.
- Respond professionally to legitimate intellectual-property concerns.
- Seek qualified intellectual-property counsel where a particular product, mark, design, or claim presents a material legal question.
SECTION 13: AFFIRMATION
Sole Revival and Redemption LLC is committed to independent creativity, transparency with its customers, and responsible intellectual-property practices.
SRR's compliance policies are designed to reduce consumer confusion, accurately describe its merchandise, distinguish independently offered SRR products from authentic third-party retail merchandise, and promote compliance with applicable law.
Nothing in this policy is intended to claim ownership of third-party intellectual property or imply a commercial relationship with a third-party rights holder where none exists.
